TERMS AND CONDITIONS OF THE ONLINE STORE

These Terms and Conditions govern purchases made through the YULIYA BABICH online store at https://shop.yuliyababich.eu.

The Online Store operates in accordance with applicable Polish law and European Union consumer protection legislation.

Hereinafter referred to as the "Seller" or "Company".

II. DEFINITIONS

For the purposes of these Terms and Conditions:

1. Customer — any natural person, legal entity or organisational unit entitled to enter into contracts that uses the Online Store.

2. Consumer — a natural person purchasing products for purposes not directly related to their trade, business or profession.

3. Online Store — the e-commerce website operated under the YULIYA BABICH brand.

4. Goods — clothing, fashion accessories and other products offered for sale through the Online Store.

5. Order — a declaration submitted by the Customer expressing their intention to purchase selected Goods.

6. Sales Contract — a contract for the sale of Goods concluded between the Seller and the Customer.

7. Terms and Conditions — this document governing the operation of the Online Store and purchases made through it.

8. Business Day — Monday to Friday, excluding public holidays in Poland.

9. Custom-Made Product — a product manufactured according to the Customer's individual specifications or clearly personalised for the Customer.

10. Consumer-Entrepreneur — a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for that person, within the meaning of applicable Polish law.

III. GENERAL PROVISIONS

1. These Terms and Conditions govern the use of the Online Store, placing orders, concluding Sales Contracts, payments, delivery, returns, exchanges and complaints.

2. The Online Store operates in accordance with applicable Polish legislation, including the Polish Consumer Rights Act, the Polish Civil Code, the Act on Providing Services by Electronic Means and applicable European Union regulations.

3. The Seller offers clothing and fashion products under the YULIYA BABICH brand.

4. Product descriptions, photographs, sizes, materials, prices and availability are displayed on individual product pages.

5. Product photographs are intended to represent the Goods as accurately as possible. Minor differences in colour appearance may result from individual screen settings. This does not exclude the Customer's statutory rights where Goods do not conform to the contract.

6. The Seller reserves the right to modify the product range, prices and product descriptions, without affecting Sales Contracts already concluded.

7. The Customer may access these Terms and Conditions free of charge and save or reproduce them for personal reference.

IV. USE OF THE ONLINE STORE

1. Customers may browse the Online Store and place orders 24 hours a day, seven days a week, subject to technical maintenance or interruptions.

2. To use the Online Store, the Customer requires an internet connection, a compatible web browser and a valid email address for order communication.

3. The Customer agrees to provide accurate and complete information when placing an order.

4. Customers must not use the Online Store for unlawful activities or interfere with its technical operation.

5. Placing an order does not require the creation of a Customer account where guest checkout is available.

6. The Seller provides electronic services through the Online Store, including browsing product information, shopping cart functionality, checkout and, where available, Customer account services.

7. Electronic services necessary for browsing and placing orders are provided without a separate service fee. Customers bear their own internet connection costs.

8. Complaints concerning the technical operation of the Online Store may be submitted using the contact details provided in Section I.

9. Customers may discontinue browsing or using the shopping cart at any time. Where Customer accounts are offered, account closure may be requested without affecting existing contractual or legal obligations.

V. PLACING ORDERS AND CONCLUSION OF THE SALES CONTRACT

1. Orders may be placed through the Online Store by selecting products and adding them to the shopping cart.

2. Before submitting an order, the Customer is provided with information concerning the selected Goods, total price, applicable taxes, delivery charges and available payment methods.

3. The Customer must provide the information necessary to process the order and complete the checkout procedure.

4. The final order button must clearly indicate that placing the order entails an obligation to pay.

5. Submission of an order constitutes an offer by the Customer to purchase the selected Goods.

6. The Seller will send an electronic acknowledgement of receipt of the order.

7. The Sales Contract is concluded when the Seller sends an email expressly confirming acceptance of the order. An automated acknowledgement of receipt does not constitute acceptance unless it clearly states otherwise.

8. The Seller will provide confirmation of the concluded Sales Contract on a durable medium, such as email, including the information required by applicable law.
